A client isn't paying your invoice

You did the work or delivered, but the invoice stays open. As a business you're entitled to interest and collection costs, and Dutch law says exactly from when.

Watch the deadline. With a business client and no agreed due date, statutory commercial interest runs from 30 days after receipt of your invoice. With a consumer you must first send a reminder giving fourteen days to pay before you may charge collection costs.

Business client

  • Commercial interest from the day after the agreed due date, or 30 days after receipt of the invoice if none was agreed (art. 6:119a Dutch Civil Code).
  • Payment terms over 60 days only if expressly agreed and not unfair; a large company may not impose more than 30 days on a small supplier (art. 6:119a(5) and (6)).
  • Collection costs of at least €40, without a reminder (art. 6:96(4)).

Consumer client

You may charge collection costs only after a reminder giving fourteen days to pay that states the costs (art. 6:96(6)); the amount follows a fixed scale.

What you can do

  1. Send a clear reminder with a payment deadline.
  2. If nothing happens, formal notice, then possibly a collection agency or bailiff.
  3. Claims up to €25,000 go to the subdistrict court, without a mandatory lawyer.
